Vietnam: Human rights lawyer Le Quoc Quan sentenced to 30 months imprisonment

On 27 December 2012, Mr. Le Quoc Quan was arrested by the police in Hanoi while dropping off his daughter at school. The police also searched his office and home and confiscated some documents. They apparently read out a warrant, but did not give it to Quan's family. The police told his family that he would be charged under Article 161 of the Criminal Code, which relates to tax evasion. If condemned, he risks three years in prison and a heavy fine. Quan, who began a hunger strike on 28 December was detained incommunicado in Hoa Lo Prison No. 1. Neither his lawyer nor his family were able to visit him. In addition, Quan's arrest follows a recent order by Prime Minister Nguyen Tan Dung that authorities renew the fight against anyone using the Internet to "defame and spread propaganda against the State". Quan has been harassed constantly since 2007 by the Vietnamese authorities because of his human rights activities. On 3 October 2012, some 50 security police and plain-clothed militia forced entry into the head office of VietNam Credit in Hanoi and its branch office in Saigon. The firm belongs to Quan and his two brothers Messrs. Le Dinh Quan and Le Quoc Quyet. Police seized files and documents belonging to the firm, assaulted the staff and detained the brothers for interrogation. On 30 October, they returned and arrested Le Dinh Quan, also for alleged "tax evasion". He is currently detained in Hoa Lo Prison No. 3. In addition, on 18 August 2012, Quan was brutally beaten by two unidentified men with iron bars outside his home in Hanoi. On 6 February 2013, Quan was released from prison and placed under house arrest. On 2 October 2013, Quan was sentenced to 30 months in prison for tax evasion and given a $59,000 fine. Supporters of Quan attempted to march on the courthouse but were stopped by police.

On 27 December 2012, Mr. Le Quoc Quan, human rights activist and lawyer, was arrested in Hanoi under allegations of tax evasion. He was subsequently released from prison and placed under house arrest from 6 February 2013 to 2 October 2013, when he was sentenced to 30 months in prison. Mr. Le Quoc Quan has previously suffered physical and legal harassment related to his activism. The ICJ declared on 7 October 2013 that his conviction was in violation of international standards on the right to a fair trial, and the UN Office of the High Commissioner for Human Rights has expressed alarm at the conviction.
