Human rights defenders, Mr Mian Abdul Qayoom, President of the Jammu and Kashmir High Court Bar Association, Srinagar, and Mr Ghulam Nabi Shaheen, General Secretary of the Bar Association, were arrested under the Jammu and Kashmir Public Safety Act of 1978 (PSA) on 7 July and 18 July 2010 respectively. On 7 July 2010, at approximately midnight, Mian Abdul Qayoom's home was raided and he was detained under the PSA and taken to Hiranagar Jail in Jammu. On 20 July 2010 a hearing took place in which a request was put forward for the transfer of the human rights lawyer from Hiranagar Jail to Srinagar Central Jail; this request was denied. The next hearing date has been set for 29 July 2010. Mian Abdul Qayoom is being accused of political activities in support of secession within his role in the Bar Association and of instigating recent mass protests. The protests over extrajudicial killings have been taking place over a period of a number of months, but following a crackdown by the Central Reserve Police Force at least 18 of the protesters were killed. On 18 July 2010, Ghulam Nabi Shaheen was detained on similar grounds under the PSA as well as for organising public mobilisations calling for the release of Mian Abdul Qayoom. Ghulam Nabi Shaheen is currently being held in the District Jail in Rajouri. The Jammu and Kashmir Public Safety Act allows for detention for up to two years without charge or trial on the purported presumption that they may in the future commit acts harmful to the state. Front Line believes that Mian Abdul Qayoom and Ghulam Nabi Shaheen have been targeted as a direct result of their human rights activities, particularly their legal advocacy work on behalf of those who are arbitrarily detained under the PSA as well as for past human rights violations such as disappearances in Kashmir. Front Line is concerned for the physical and psychological integrity of Mian Abdul Qayoom and Ghulam Nabi Shaheen whilst in detention.
