Thailand: Migrant workers' advocate sued for defamation by company

On 5 March 2013, Andy Hall, a prominent migrant and labour rights defender raising awareness of the plight of migrant workers in Thailand, was sued by Natural Fruits, a company which he exposed of breaching the rights of migrant workers. Natural Fruit Co Ltd, claimed that Andy Hall had damaged its reputation with libellous statements about its relations with migrant workers, according to papers at the website of the Southern Bangkok Criminal Court's website and NGO sources. Update 26/04/2013- A Joint Allegation Letter is sent to Thailand by the Working Group on the issue of human rights and transnational corporations and other business enterprises, the Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression, the Special Rapporteur on the situation of human rights defenders, the Special Rapporteur on the human rights of migrants, and the Special Rapporteur on trafficking in persons, especially women and children. Update 03/05/2013: The Thai government provides a preliminary clarification in response to the Joint Allegation Letter stating that the matter is between two private parties and will be determined according to Thai law. Update 28/09/2013: Mr. Hall has been read additional charges by police, and has been pressured to sign a document in Thai which he did not realize was a confession.

Update 26/04/2013- A Joint Allegation Letter is sent to Thailand by the Working Group on the issue of human rights and transnational corporations and other business enterprises, the Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression, the Special Rapporteur on the situation of human rights defenders, the Special Rapporteur on the human rights of migrants, and the Special Rapporteur on trafficking in persons, especially women and children. Update 18/06/2014: Mr. Hall returned to Thailand from his residence in Rangoon to hear the fourth charge laid against him by Natural Fruit Company. He was taken into police custody after the hearing (in Thai, with no official translator made available) and detained for two hours before being released on bail. His 50,000 baht bail was paid in solidarity by two of Thailand's leading food-processing associations: the Thai Frozen Foods Association and Thai Tuna Industry Association. He is barred from leaving the country, and the trial may last several years.
